Justice Soumitra Sen's resignation accepted

According to the TV reports, President Pratibha Patil on Saturday accepted the resignation letter of Calcutta High Court  Justice Soumitra Sen and has forwarded the same to the law ministry for necessary action. The Lok Sabha is now to decide whether they will take up his resignation on Monday or not.
Earlier Soumitra had send his resignation in writing to the President raising fresh questions whether the impeachment proceedings against him in Lok Sabha on Monday will go on as scheduled.
Rashtrapati Bhavan spokesperson said on Saturday without disclosing any details that a lawyer on behalf of Justice Sen had handed over the resignation letter to the President and the President is perusing it.
Sources reveal that the resignation is in order. The sources said that the constitutional entity is free to tender his resignation in his own violation and act and there is no acceptance invloved. Also added that it will come into effect immediately if the resignation is in order.
 In the constitution, there is no acceptance involved and the resignation given by a constitutional entity under hand and addressed to the President comes into effect immediately.
Sources said that the President after perusing the letter will hand it over to the department of justice for taking further appropriate action.
The government's top law official has learnt that since the format of the letter is not appropriate, it could be at any time stayed by the President and by stopping impeachment proceedings at this time, would allow Justice Sen to continue.
